Transnational & Cross-Border Projects
Counsel for projects and parties that cross borders across the United States, Latin America and the Caribbean.
Scope
Cross-border construction and infrastructure work for domestic and transnational contractors, construction managers and sureties throughout The Americas — conducted in English, Spanish and Portuguese, with a working understanding of the legal, commercial and cultural context on all sides of a project.
Cross-border projects fail for reasons that are rarely technical. A contract drafted under one legal tradition is administered by people trained in another; a term that is routine in one market has a different meaning in the next; and the parties often discover the mismatch only once a dispute is already underway.
Jerry works across the United States, Latin America and the Caribbean in English, Spanish and Portuguese, with a practical understanding of the legal, commercial and cultural context on each side of a project. That fluency — linguistic and legal — lets him keep negotiations and proceedings moving without the cost that usually comes from constant translation and re-explanation.
Much of the difficulty in cross-border work is contractual. Jerry advises on the standard-form and bespoke agreements that govern transnational projects — including FIDIC-based contracts — and on reconciling them with local law, so that obligations mean the same thing to every party regardless of where they trained or what language they negotiate in.
